As a Part 15 equipment provider in my previous life, maybe I can share some
light on the subject.  While I claim to not be an expert on the subject,
here is what I know.

 

1.      All Part 15 devices must adhere to ERP specs outlined in Part 15.
The part includes peak power into the antenna and the gain of the antenna so
the combination of power into the antenna plus the gain of the antenna allow
no more than the specified Peak ERP.  Owners of Part 15 transmitters are
subject to regulation restrictions if their equipment interferes with
another system and of course they are subject to outside interference also.
2.      Within Part 15, as I recall, portable phones are covered but
wireless microphones are not.  The reasoning is the ERP of a wireless
microphone is so low its signal can not penetrate walls.  Wireless mics
typically operate in UHF band and some manufacturers are trying frequency
diversity to help combat outside interference.
3.      As I recall, the only language in Part 15 that identifies exempt
appliances is Part 15.103, Paragraph f which exempts devices with a power
consumption of less that 6 nW.  Another possible exemption is Paragraph d
where the paragraph refers to appliances and you might be able to stretch
the definition and call a wireless mic an appliance.

Help clarify my (mis)understanding of Part 15:

1. If a manufacturer declares that it is approved by the FCC as a device
under Part 15, does that not mean that it is approved for operation without
a licences (so long as it doesn't cause interference)?

2. Within Part 15, can only those intentional radiators that are
specifically discussed in Part 15 be approved? Part 15 specifically provides
information for certain types of equipment. Does that exclude all other
types of equipment and purposes? For instance, it specifically talks about
Cordless Telephones, so clearly they can be licensed as a Part 15 device.
However, I see no mention of a baby monitor, and those are sold as a devise
not requiring licensing. 

3. Is there language somewhere that specifically excludes a wireless
microphone as being able to operate without a license?

4. Are there any wireless microphones on the market that are claiming Part
15 acceptance?
