My question is, especially in view of the last quote above, how come
only the OTA affiliates and OEOs are socked with this fine? How come
each MVPD net that aired it between 6 PM and 10 PM isn't also being
fined?
Content delivered by MVPDs is not regulated by the FCC. Subscribers
pay for the service and can watch anything they want, including the
porno-lite that is carried by most MVPDs.
It is actually the licensed stations that are liable, since THEY are
the ones using the public airwaves - regulated by the FCC - to
deliver content from the networks and other sources. Typically the
networks pick up the tab for these violations (they own stations too).
