When you go into pit bull mode like this you are merely acting as a
troll. I doubt you will either discredit Bert or drive him from the
list with these tactics but it does make things somewhat less pleasant
here.
Maybe we could tone it down a bit.

I'm sure that the same type of 'legal' analysis was used by others at his
employer to:
1) Charge $600 to the government for an off-the-shelf crescent wrench
2) Charge $900 to the government for an almost-off-the-shelf toilet seat cover
3) Bribe several Navy official (directly using Boeing funds) through one Melvin
Paisley
4) Bribe (by hiring, despite a non-disclosure agreement) a Northrup-Grumman
employee, with a bonus when he 'brought along' confidential cost-estimate
documents from Northrup-Grumman that Boeing OFFICIALs then used to 'bid-rig'
their competing bid to the government
5) Agreeing to hire Colleen Druyan from her Air Force position (secretly)
effectively on the proposition that she throw the Air Force replacement tanker
contract to Boeing.
6) Harvey Stonecipher (married) having an affair with a female subordinate
(also married) while spending company funds and company time on executing and
hiding the affair.
Bert obviously, and his company, also obviously, were born without original
sin. They are incarnately inerrable. When others go to jail, it was the fault
of the errant, not them.

That is what the US Govt is doing here, ON OUR BEHALF. It is saying to content
owners and to broadcasters, "If you guys want to air this content over the RF

following certain rules, THEN we, the people, are going to negotiate the terms.
"Our terms are [Betamax case, 17 USC 1201]. If you don't like our terms, we agree
that you own the content and have rights to it, so please take your content elsewhere for
display."
And more, we, the people, are saying to broadcasters that if they want to use
the publically-owned TV RF spectrum, they have to transmit at least one free
and clear SDTV stream. Or take their business elsewhere.
By the way, I think it is the tactic of the complete idiots and morons to try
to silence opposing points of view through insults. Deep down, pathetic,
self-loathing bullies and narcisists. No one worthy of respect, for sure.
Surely, we can agree on that much?
