This decision is contrary to logic, was a hasty correction of an earlier and
questionable decision, and hasn't stood the test of time.
Indeed, as anyone who has followed the issue of broadcast
obscenity/indencency can attest, once the FCC won the "Seven Dirty Words"
decision (which illogically, by the way, said that there were significant
number of children in the radio audience of WBAI-FM at noonish on a 1974
weekday while school was in session) they did virtually NOTHING to enforce
the matter for close to three decades.
Then, we enter the period of Sturm and Drang. Has anyone but me -- and the
Wall Street Journal of last week -- noted that since Kevin Martin became
chairman, obscenity/indency rlings have stopped being issued? Do you tkink
it might have something to do with the thin rationale and even thinner legal
basis -- at this time -- for the fines?
