Progress on info sharing threatened by changes to FOIA law

Experts warn that a bill introduced last week in the U.S. Senate could
reverse protections given to private sector owners of the nation's critical
infrastructure granted by the Homeland Security Act (HSA).  The act allows
private companies greater assurances that any data they share regarding
critical infrastructure vulnerabilities would not be subject to Freedom Of
Information Act requests.  However, Sen. Patrick Leahy (D-Vt.), one of the
bill's sponsors, claims that "these provisions ... shield from FOIA almost
any voluntarily submitted document stamped by the facility owner as
critical infrastructure," Leahy said on the floor of the Senate last week.
"The law effectively allows companies to hide information about public
health and safety from American citizens simply by submitting it to the
Department of Homeland Security."
