Have Web Downloads, Court Rules

The United States Ninth Circuit Court of Appeals has ruled that the state 
cannot ban prisoners from receiving mail that contains Internet downloads. The 
lawsuit from an inmate of California's Pelican Bay State Prison says a policy 
requiring material from the Internet to be either retyped or hand-copied from 
the original in order to be sent to prisoners violates the First Amendment's 
free speech guarantees. The court found no legitimate security reason for the 
ban, since it banned material from the Internet "simply because their source is 
the Internet." The court would accept as legitimate restrictions on the number 
of pages or such content as bomb-making instructions. California prisoners are 
not allowed direct Internet access.
