Computer Student on Trial for Aid to Muslim Web Sites

Omar al-Hussayen, a 34 year old Saudi Arabian doctoral student in Moscow,
Idaho, is currently on trial for providing "expert guidance or assistance"
to terrorist groups for serving as webmaster of several Islamic websites
with jihadist views. Mr. Hussayen's lawyers argue that though he helped
maintain the websites, Mr. Hussayen does not hold jihadist views. Mr.
Hussayen served as a technical editor, and should not be criminally liable,
the defense argues. Mr. Hussayen's case will test the "expert guidance"
provision of the USA Patriot Act. David Cole, a Georgetown University law
professor, has argued against the provision, giving the example of someone
who fixes a fax machine owned by a terrorist group as an overextension of
the law. Justice Department officials charge that in addition to
maintaining websites, Mr. Hussayen funneled money to charities with ties to
terrorist organizations.
