Ruling shields AOL on 'hostile code'

The U.S. Court of Appeals, Third Circuit, has ruled that America Online and
other Internet service providers are not liable for "hostile code" sent
between subscribers. The ruling concerns Section 230 of the Communications
Decency Act, which gives an ISP immunity from prosecution for a
subscriber's sending of "actionable words." The ruling defines
"information" not just as knowledge or intelligence, but also the sending
of an electronic signal, putting hostile code into the category of
actionable words. The purpose of Section 230 is to protect ISPs from having
to act as Internet police. This immunity does not extend to copyright
violations in file sharing.
