New Ways to Skirt DMCA . . . Legally!
The United States Copyright Office and the Librarian of Congress have ruled
on several new exemptions to the anti-circumvention clause of the Digital
Millennium Copyright Act (DMCA). The DMCA makes it illegal to circumvent
copy-protection measures to gain access to copyrighted content, but
requires a review of possible exceptions every three years, to protect
non-infringing fair use. The Copyright Office released four new exemptions.
Users may bypass obsolete dongles to access computer programs, access
software and video games in obsolete formats, as well as e-books with a
disabled text-to-speech function, and circumvent digital locks to lists of
websites that filtering companies block. However, consumer exemptions
proposed by the Electronic Frontier Foundation were not granted, including
work-arounds for region coding on DVDs, copy-protection on CDs that make
them unplayable in certain devices, and the Content Scrambling System (CSS)
for DVDs of public domain films.
