Judge bars sending of unwanted e-mail

New York State Supreme Court Justice Lottie E. Wilkins barred Niagara
Falls-based company MonsterHut.com from sending mass emailings, also know
as spam, to millions of Internet users. State officials accused
MonsterHut.com of sending 500 million unsolicited commercial emails and
then telling complaining recipients they had "opted in" to the email.
MonsterHut.com argued that they purchased the email addresses from third
parties who had received opt-ins, and thus bought permission from the
consumers to use those addresses. The judge said MonsterHut.com had "not
offered any proof or legal basis to demonstrate that their practice
conforms with industry-wide accepted 'opt in' protocols."
