Expressions/Expressions of Folklore

A possible reading list


Introduction

The annexed list comprises references to materials and documents concerning=
=20
the work of the Intergovernmental Committee on Intellectual Property and=20
Genetic Resources, Traditional Knowledge and Folkore (the Committee) of the=
=20
World Intellectual Property Organization (WIPO).

The Committee meets again from November 1 to 5, 2004, in Geneva.  This will=
=20
be its seventh session.  The immediate focus of the annexed list is,=20
therefore, the new documents that will be discussed at this session.  See=20
list under heading =91Key current documents=92.

The list includes working documents prepared by the WIPO Secretariat, as=20
well as proposals, submissions, statements and studies prepared by Member=20
States, intergovernmental organisations and non-governmental organisations.

This list comprises materials prepared by WIPO and/or for sessions of the=20
Committee.  It does not seek to represent all relevant materials on these=20
topics.  There is a considerable amount of other valuable literature on=20
these subjects.


The Committee in general

The Committee addresses three related yet distinct themes, namely IP and=20
access to and benefit-sharing in genetic resources, the protection of=20
traditional knowledge and the protection of expressions of=20
folklore/traditional cultural expressions (TCEs/EoF).

In this context, =91traditional knowledge=92 refers specifically and some=
 what=20
narrowly to technical knowledge and know-how concerning biodiversity,=20
medicine, agriculture and the like.  Discussions concerning genetic=20
resources often also address the related question of =93traditional=
 knowledge=94.

=93Traditional knowledge=94 and TCEs/EoF are also closely related in=
 practice,=20
especially from a community perspective.  They are therefore addressed by=20
the same Committee and in parallel.  On the other hand, they each also=20
raise some distinct legal, policy and practical issues, and generally=20
involve a different set of interests and stakeholders.  Unlike with=20
=91traditional knowledge=92, there is also significant national, regional=
 and=20
international experience with the protection of TCEs/EoF.  Therefore,=20
=93traditional knowledge=94, in this narrower sense, and TCEs/EoF are=
 discussed=20
distinctly.

This list covers both =91traditional knowledge=92 and TCEs/EoF, although for=
=20
reasons of space slightly more emphasis is placed on TCEs/EoF, especially=20
concerning past materials.  Many of the documents and materials referred to=
=20
cover both =91traditional knowledge=92 and TCEs/EoF.
