Surely it becomes a public service, just like the private "full sized", 
ex-British Rail organisations, such as the North Yorks Moor railway, and 
thus have to have full passenger liability insurance, third party insurance 
etc., Not to mention being approved by the Health and Safety Executive, AND 
running to published time tables!

Incidentally, when I was working on Sheffield's Light Rail (tram) project, 
although a lot of it was running on-street, mixed with ordinary traffic, 
every inch of the route still had to be approved by the Railway (H.S.E.) 
Inspectors. We even had to wait at one point as they were all called away to 
the Paddington rail disaster (I think it was, the one in the early 90's 
anyhow)!
