It depends on how you interpret what that regulation requires.
Interpretation 1: The page needs to provide markup that facilitates user
agent features for skipping repetitive navigation links.
In this interpretation, heading, list, and paragraph markup, combined
with features such as keyboard shortcuts moving to headings (Opera
browser, JAWS, Window-Eyes), skipping groups of links to the next text
(JAWS, Window-Eyes), navigation by block (Apple VoiceOver), spatial
navigation (Opera Desktop), arrowing around the page (Firefox 3 and
Internet Explorer 8), and list compression and expansion (Opera Mini)
meet this requirement.
Some users will be stuck because their chosen user agent doesn't include
any functionality like this. e.g. the best you could do in Internet
Explorer 6 without any assistive technology software is use the find
command to jump to later text.
The test here would be to check that the markup is correct by viewing
source. You could also use the JAWS commands for navigating between list
items and headings to check the markup is working correctly.
Intepretation 2: The page needs (additionally) to provide a mechanism
for skipping repetitive navigation links, independent of user agent
features until common user agents include such features.
This is an interpretation influenced by WCAG 1.0. Here, you need to
check the same as for Interpretation 1, but also check for the existence
skip links when there are lots of navigation links.
I'm a web developer not a lawyer and tend to be looking at WCAG 2.0 not
Section 508, so please don't consider this advice authoritative.
