Well maybe we are talking about different things, but here is what the
FTC says about it:

From what I read, and remember from classes, that as long as you don't
do anything illegal to get it or keep it, it's ok in a legal sense to
have a monopoly.  Though I'm definitely not a lawyer, nor really an
expert on the matter, it's just what I recall.
