There is a licence given, it's the MIT licence.
Though not all software inside Haiku is under MIT licence, you'll need 
to check the other ones.

No, but some stupid software patents in some obscure countries cover 
methods used by software inside Haiku (certainly on libavcodec & 
others).
It is up to you to find if you care about sw patents or not and handle 
those.
