That may be true, but using the important things out of the driver code such as 
registers, and interupts cannot be copyrighted persay since they exist only to 
interface with the hardware. :-)

Remember that copyright extends beyond just the exact code.
If you write the exctly the same code (or close enough) it is considered the
same.
It is the same as singing a song, changing the names doesn't make it a unique
song and so it is bound by copyright.
