DVI is still unencumbered, IIRC.

No, on both HDMI and DVI HDCP is optional. Of course if you want to play back encrypted Blu-Ray content on compliant playback software than it is not optional, but your problems with HDMI for a regular desktop are definitely not caused by HDCP. It should just work and in fact there are simple adapters for DVI->HDMI that you can use to convert the cable.
