I'd argue with your interpretation of this licensing spec. By defining a
user account, giving it an address (which becomes a personally identifiable
attribute related to the person in question), and forwarding mail that goes
to that address, I believe you are indeed "using the server software."  

But you're right that they should speak with Microsoft to verify this.

No, I don't think so. Feel free to call a licensing specialist. In fact,
I would recommend A.M. Salim do so to verify this to their satisfaction.

Microsoft Licensing Product Use Rights, the official Microsoft document
that defines these items, says, and I quote:

Client Access License ("CAL") Requirements
In addition to the license for the Server Software, you must acquire an
Exchange Server 2003 CAL or Core CAL for each individual person ("User")
or device that accesses or uses the Server Software. Access or use of
the Server Software means access, whether directly or through a
"multiplexing service" which is defined as a software application or
service accessing or using the Server Software at the request of or on
behalf of a User or device.

Quote complete.

The user who is being forwarded to neither accesses nor uses the Server
Software.

The proper way of looking at this is not:

they are not really using Exchange other than as a forwarding engine.

But:

Hi all,

I have a client who has about 20 real mailboxes, and then they have
about 80 users who won't have email boxes, just forwards to an external
email like their personal AOL or a hotmail accounts.  This is for a
church.

The only method I can see in Exchange requires me to install "real mail
enabled accounts" for each one and then set each one to forward, but
from a CAL (licensing) point of view, these 80 users would still have to
pay for a CAL license even thought they are not really using Exchange
other than as a forwarding engine.

Any ideas on how I can accomplish this without making having to set up
real mail enabled accounts in Exchange?
