I think the Judge would be an absolute tool (to use a technical term) to grant
NTP an injunction. 2 of NTP's patents have received FINAL review from the
USPTO and they were denied as invalid. All their other patents have been
denied as invalid but they just haven't passed the final review.

So, if the judge puts an injunction on RIM, as soon as the last patents get
denied, the injunction will have to be lifted, but no one knows exactly when
final review will be handed down.

If the judge gives NTP an injunction on the multi-mode workaround, then I think
RIM wil settle. They can afford up to 1 billion in settlement without adversly
effecting them as a company.

This entire thing is about money, NTP wants money, and if BB was shut down
forever, NTP won't continue to pull in money. But in the end, it's pretty much
a given that NTP will loose their patents.

There's also been a suit launched against Goodlink, one of Blackberry's
competitors. NTP is involved in that one as well.

What happens?
Its pretty simple.

A) Nothing
B) Injunction set, work around released. Upgrade servers and handhelds.
C) Injunction set, work around released, NTP asks for injunction of that, and
gets it. BB Shut down.

Its all just a wait and see right now. Unless your company is willing to invest
in all new hardware, just in case.
