You are talking about 2 different things, Ownership and Liability.

In a hosted configuration where you have outsourced the e-mail service,
ownership of the messages is yours. The hosting service is merely acting as
your agent at that point. The hosting service is bound by the agreements
that is has with you, which generally means your privacy is respected. 

Liability on the part of the hosting company is different, in that they are
providing a service and must take appropriate steps to protect client data.
