Yes and no. U.S. case law is pretty clear for service providers. If we
receive a court order to release data, we do so (never happened, but
this is spelled out in the contract). If we have reason to believe that
our AUP is being violated we investigate, along with the customer. 

The liability we have is similar to that of an auto mechanic. We provide
reasonable commercial efforts to protect your data (usually these
efforts are better than companies have in their own facilities). We
provide a service. We store your data. If a court orders us to turn it
over, we turn it over.

Are we responsible for content? Absolutely not, UNLESS we knowingly
provide a client the capability to store/transmit illegal material.

Well - what are the pros and cons for doing this - outsourcing - is it
costly
- can we send to 1500 on one distribution list if we outsource - are we
bound by rules that we would not be bound by when I can turn around
right now and look at the Exchange Server?  I think there is probably no
doubt that it might be less expensive to outsource than to keep
replacing servers every three years - but maybe that's not necessarily
true either.

My office (because we are so small) is thinking about outsourcing email
to a larger company that can deal with replacing servers, etc. and
keeping down costs I am trying to gather the PRO's and CON's so I can
make a valuable presentation.
 
When asked the question what do we lose by outsourcing our email - I am
not sure since we have not tried this configuration except to have AOL -
which I am really not fond of.
I would appreciate your input if you have time - I know this may be a
little off the norm for this list - but you have helped me considerably
in past months
