The issue I am going to discuss with you all is about the DMCA, The Digital Millennium Copyright Act. The DMCA is a United States statute prohibiting certain types of activities on copyrighted work, such as breaking encryption. The reason people are up in arms about this is it is too general of an act and that it violates previous laws already instated. These laws being: "Fair Use" is a doctrine that allows limited use of copyrighted material without requiring permission from the rights holders, such as use for scholarship or review. That mean that a person can use copyrighted material to do something like prove a software program like windows is safe from outside attacks by examining the software and looking for holes. there was a case awhile back about a guy name Dimitry Sklyarov that came to america for a computer convention to show people that the Adobe software was not secure like they said it was and Adobe had him arrested. What he did was went around the so-called security Adobe had in its products to show people (or review as stated in Fair Use laws) that the product needed work. None of these laws pertain to him in Russia where he did his research, but as soon as he landed on US soil he was found to be breaking the DMCA act. The charges against Sklyarov were later dropped in exchange for his testimony. So the law is to vague and even the government knows this as they threw the case out against him and the company he was working for. People are demanding that the DMCA is revised and the laws made more clear.
