Jury hands cop-push gal $1.3M

By DENISE BUFFA

October 26, 2007 -- A jury yesterday awarded $1.35 million to a legally blind
woman whom cops allegedly pushed down a flight of stairs during an eviction
from her Bronx home in 2003.

It marks the second time Juanita Young has won a jury award for excessive force
by police.

She got $10.5 million in connection with the 2000 shooting death of her son,
Malcolm Ferguson, during a 2000 Bronx drug raid.

The city has appealed that verdict, and is weighing an appeal of this one.

Young's lawyer, Seth Harris, said, "This was a well-reasoned verdict that has
finally vindicated" her.

Ferguson, a 23-year-old paroled drug dealer, was shot once in the head while
struggling with a cop in his Bronx apartment building during an undercover drug
raid. No criminal charges were brought against the officer, who claimed his
weapon discharged accidentally.

In yesterday's case, Young, a mother of five, claimed the cop who kicked her
out of her apartment later told her, "There won't be any rallies for you today,
Miss Young."
