I'm not even sure it's strictly OK to record the jazz band, unless all their material is their own.

I didn't know until recently that my doctor, who plays a commercial radio station in the waiting room, now needs a licence to do so because it's public perfomrance.

Just some examples of the way the music biz can make life awkward. You only have to listen to Adam Curry's Daily Source Code (feed - http://radio.weblogs.com/0001014/categories/dailySourceCode/rss.xml) to hear plenty of rants about this sort of thing. That's why podcasters usually go Podsafe or compose their own music.
