I don't know if they have to present evidence in court about people being confused and even if so how many.

Probably FS is hoping Saratech will settle out of court for an
undisclosed sum of money, and with a gag order preventing either
firm from discussing anything about the case or settlement.

Not sure if I were Saratech if I would want a jury trial or not.
If the case hinges on an interpretation of law, it usually won't
have a jury as jurors are not normally experts at interpreting
the law.

Wonder if FS has kept a log of exactly when and who called them
for tech support on their Freedom box?
