Interesting headline but when you get in to the technicalities I seem to recall
that the reason the case was won was the failure of the examining body to allow
the candidate to take her notetaker in to the exam room. Unfortunately because
of this discrimination we never got as far as finding out what would have
happened should the computer based exam package itself proved not to be
accessible. Sams employer bought in to an accreditation from a 3rd party who
then subcontracted out the examimation provision tn another provider. The
finding was against the provider of the examination but I'd of liked to see the
liabilities explored too. Were not the accreditation providers responsible for
making sure they contracted in a fit for purpose sub contracter, was the
employer liable for purchasing a none discriminatory provider etc etc. as every
lots of other angles that complicated the case so yes good to have case law but
also leaves a lot of questions unanswered.

when it failed to make its computer-based exam accessible to her. The tribunal
ruling is the first to find a US company with no presence in the UK liable
under the UK's Disability Discrimination Act.
