Trademarks are very important to a company, or to a person for that matter
because it protects their design, their name, or their logo.
They also cost, at the most basic level, where you are only covering a
single class, around $430 to set up (this includes a 'Part 1' fee, a 'Part
2' fee and a Registration fee) and that only covers you in Australia. It
also takes over 7½ months to gain registration if all goes well and there
are no prior claims on the trademark.
Once a trademark is accepted, there is a three month 'opposition period'
where others can oppose the application.
If you want to protect your trademark under several classes of business
types, it costs $90 per class as a Part 2 fee and $250 per class for the
registration. So it could cost thousands to cover a single trademark under a
number of classes and remember, this is only for Australia.
So, having gone through all that, why do some companies not protect them. It
mystifies me and can only be put down to staff ignorance and management
apathy.
One of the requirements of having a trademark is that you 'protect' it. This
means you need to clearly identify your trademark as such and defend it when
/if there is a transgression.
Nuff said from me. There are bucket loads online.
And BTW. No you didn't Bob, you bought a jar of "blackberry jam" (note the
lack of capitals). The use of any capitals would be a titling issue rather
than a naming convention one. The brand name, however, would be a different
issue and will probably have a ? or ® symbol somewhere on the label. :)

trademarked the name and own it. To me, the problem with this comes in when
ludicrous trademarks are granted for generic words that people should have a
right to use generically (like Windows). But a product brand name like
Frigidaire or BlackBerry is an asset of a company and I don't think it's
unreasonable for them to try to protect it.

Since when is Blackberry not a generic word?
Today, I bought a jar of Blackberry Jam.
Maybe if the label was written BlackBerry it would send emails, or maybe I
could email a sandwich or ...
Would it then look out the Windows, chat to the Apple using Word and have a
Mouse attached?
BTW, what is the generic word for Velcro?
