The thing is, Kevin, if you do write to them, then you might
get written=20
evidence of their discrimination. If they don't reply, you
haven't lost=20
anything other than a little time and the cost of a stamp.

derek, sure i could right to the company in question, which
will achieve one
of two things. 1. they'll ignore the letter entirely, hence
i'll be no
better off. 2. they'll write back giving me reasons why "in
their opinion" i
can't do the job. reasons i've already heard and disagree
with totally,
again i'm no better off. i could contact the CAB, for all
the use that'll
be. i've had dealings with the CAB in the past and frankly
all they can do
is ... give advice! they don't have any authority to do
anything. again i'm
no better off.i need to speak with someone who knows the DDA
inside out
before i contact your move, because i want to be prepared
and have
documentation written by someone who knows what they are
talking about.
sorry but CAB can't provide that, they are an advice bureau,
hence their
name, in other words, no teeth! and writing to your move
without such
evidence isn't going to help. they are hardly going to write
back and say:
"sorry mr. lyon, yes we have discriminated against you, we
appologise and
the job's yours". what i don't need is wishy-washy nonsense
like i got from
both DRC, who basically gave a handful of reasons why i
might have a case,
then gave one reason why i might not and then washed their
hands of it), and
RNIB who basically didn't want to know fullstop.

Hi Kevin
I note the Drc said:

"it could be said that you have been treated less favorably,
it could also
be said that direct discrimination could have taken place.
Direct discrimination occurs when a person makes assumptions
about a
person's
disability purely based on the fact that they have a
disability.
"It could be said that the lady at Your Move assumed you
would not be able
to
do the role of estate agent because you are registered
blind, she did not
consider your own individual capabilities and did not look
at reasonable
adjustments which could have been made for you."

But you have also been told by DRC

"Unfortunately, as there was not a particular post that had
been advertised
that you were turned down for it could be difficult to prove
that
a position would have been offered you if you did not have a
visual
impairment.
The lady could say that there were no positions vacant."

What is wrong with the advice you were given which was:

"I would suggest that you write a letter to Your Move and
ask for
justification on the treatment you received and explain that
you feel that
discrimination did take place. If you receive a response you
are more than
welcome to contact the Helpline again to inform us of the
response but you
maybe unable to take any further action as you were not
turned down for a
particular post."

RNIB says:
"RNIB does not have anyone who can assist with employment
law. I would
suggest you approach your local Citizens Advice Bureau, as
they can
assist with employment law."

So what's the problem there. you have been given advice how
to get
help and the help is free.

Regards,
Derek
