it is consistent
with Section 623 of the Communications Act to require that a
broadcaster's
digital signal must be available on a basic tier such that
all broadcast
signals are available to all cable subscribers at the lowest
priced tier
of service, as Congress envisioned. See Carriage of Digital Television
Broadcast Signals, 16 FCC Rcd 2598, 2643 (2001)."
So, catv firms that purport to charge more than basic, basic, basic,
basic analog cable for access to DTV signals are either fooling
their customers or otherwise engaged in flim-flam.
Gives them strong incentive, post-analog, to eliminate analog cable,
since each analog channel bandwidth can be used for multiple digital
channels.
I believe that the FCC addressed this with their rules for cable post
DTV transition.
