I went back to Oak Hill cemetery around 10:00 am today (Feb 24) and quickly 
found the merlin perched in the top of a spruce tree.  Lots of noise and 
equipment near him but he didn't seem bothered.  He perched here for 30 minutes 
while I took digital video.  As I moved back to the car the flew to another 
perch about 3/4 the way up in a spruce and about 1/2 way out on the limb from 
the trunk.  Under current lighting conditions I would never have seen him if I 
had not watched him fly into the tree.  He sat there for about an hour as I 
walked around shooting pictures with a digital camera.  Terrible lighting for 
photography, but I'll post what I got along with the photos from Feb. 18 at 
http://photos.yahoo.com/phoxinus02 under the folder ETX-90.  He was still 
perched in the same tree when I left around noon.  See my previous post for 
directions to the area in Oak Hill Cemetery where I have seen the merlin.
